Waste Collection Fulham Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Fulham provides waste collection and related services to residential and commercial customers. By placing a booking, you agree to be bound by these Terms and Conditions, which apply to all services unless otherwise agreed in writing.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the individual, business, or organisation requesting waste collection services.

Company means Waste Collection Fulham, the service provider.

Services means any waste collection, clearance, loading, removal, transport, and disposal services provided by the Company.

Waste means any items, materials, or substances the Customer requests the Company to collect and remove, subject to applicable waste regulations and these Terms and Conditions.

2. Scope of Services

The Company provides scheduled and one-off waste collection services for general household, commercial, and recyclable waste, subject to applicable laws and regulations. The precise scope of the Services for each booking, including the type and volume of waste to be collected and the collection location, will be confirmed during the booking process.

The Company reserves the right to decline collection of any waste which is prohibited by law, presents a health and safety risk, or falls outside the agreed scope of the booking. This includes, but is not limited to, hazardous substances, clinical waste, certain electrical items, and any materials requiring specialist handling or permits.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through an online enquiry or booking form, where available. The Customer must provide accurate and complete information, including the collection address, access details, type and approximate volume of waste, and any relevant restrictions such as parking or time limitations.

3.2 A booking is only considered confirmed once the Company has issued a confirmation by email or other written form of communication, or has clearly confirmed acceptance of the booking by telephone and agreed the date, time window, and indicative charges.

3.3 The Customer is responsible for ensuring that all information supplied is accurate. If, upon arrival, the nature or quantity of waste differs significantly from the description provided, the Company may adjust the price, require a revised agreement, or decline to carry out the Services in whole or in part.

3.4 Time slots for collection are estimates only. While the Company will make reasonable efforts to attend during the agreed time window, timings are not guaranteed and may be affected by traffic, access, or operational constraints. The Company shall not be liable for delays beyond its reasonable control.

4. Customer Responsibilities

The Customer must ensure that:

a. The waste to be collected is clearly identified and accessible at the agreed collection point.

b. Suitable access is available for the Company’s staff and vehicles, including any necessary parking or entry permissions.

c. Any required permissions from property owners, managing agents, or local authorities have been obtained prior to collection.

d. The waste does not include any items that are prohibited under applicable waste regulations or under these Terms and Conditions.

If the Company is unable to carry out the Services due to access issues, incorrect information, or the presence of restricted waste, the Company may charge a call-out fee or a proportion of the agreed charges to cover time and costs incurred.

5. Pricing and Quotations

5.1 The Company may provide price estimates or quotations based on the information supplied by the Customer. These may be given as fixed prices, load-based prices, weight-based prices, or time-based charges, or a combination of these methods.

5.2 Any quotations provided prior to arrival are indicative and may be adjusted on site if the nature, volume, weight, or handling requirements of the waste differ from the initial description. In such cases, the Company will explain any price adjustments before proceeding.

5.3 All prices are exclusive of any applicable taxes or statutory charges unless explicitly stated otherwise. The Customer remains responsible for any charges such as parking fees or congestion charges directly imposed as a result of the collection, unless otherwise agreed.

6. Payments and Invoicing

6.1 Unless agreed otherwise in writing, payment is due on completion of the Services at the point of collection. The Company accepts payment by cash, card, or other methods as notified to the Customer.

6.2 For account customers or commercial customers with agreed credit terms, the Company will issue an invoice following completion of the Services. Payment terms will be specified on the invoice. If no specific terms are stated, payment shall be due within 14 days of the invoice date.

6.3 If the Customer fails to make any payment by the due date, the Company reserves the right to charge interest on overdue sums at the statutory rate permitted under applicable UK law, from the due date until the date of actual payment in full.

6.4 The Company may suspend or withhold further Services if any sums remain unpaid beyond the due date, without liability for any delay or non-performance arising from such suspension.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting the Company during normal business hours.

7.2 If the Customer cancels more than 24 hours before the scheduled collection time, no cancellation charge will usually apply, unless a specific non-refundable fee has been agreed in advance for specialist arrangements.

7.3 If the Customer cancels within 24 hours of the scheduled collection time, or fails to provide access at the agreed time, the Company reserves the right to charge a reasonable cancellation or call-out fee to cover costs and loss of opportunity.

7.4 Where the Company needs to cancel or reschedule a booking due to operational issues, adverse weather, staff illness, vehicle breakdown, or other circumstances beyond its reasonable control, the Company will notify the Customer as soon as reasonably practicable and offer an alternative date or time. The Company will not be liable for any indirect loss arising from rescheduling or cancellation in such circumstances.

8. Waste Handling and Regulations

8.1 The Company will handle, transport, and dispose of waste in accordance with applicable UK waste legislation and relevant environmental regulations. Waste will be taken only to appropriately licensed facilities or treatment centres.

8.2 The Customer is responsible for ensuring that the waste presented for collection does not include hazardous or prohibited materials. Such materials may include, but are not limited to, asbestos, chemicals, solvents, oils, paint, gas bottles, clinical or medical waste, radioactive materials, and certain electrical or electronic items that require specialist processing.

8.3 If prohibited or hazardous materials are identified during loading, the Company may refuse to remove them and may, at its discretion, remove the non-hazardous elements only. If such materials are discovered after removal has taken place, the Customer may be liable for any additional disposal costs, regulatory penalties, or remedial expenses incurred by the Company.

8.4 The Customer agrees to cooperate with any reasonable requests from the Company to classify or describe the waste accurately, and to provide information needed for compliance with duty of care obligations, consignment notes, or any other regulatory requirements.

9. Access, Parking, and Property

9.1 The Customer must ensure that the collection point is safe and suitable for access by the Company’s staff and vehicles. This includes ensuring that driveways, entrances, and pathways are reasonably clear and that any known hazards are disclosed in advance.

9.2 The Customer is responsible for securing any parking permits, visitor access permissions, loading bay authorisations, or similar arrangements needed to allow the Company to carry out the Services. Any penalties or fines resulting from incorrect or inadequate information provided by the Customer may be charged to the Customer.

9.3 The Customer shall take reasonable care to protect their property before the Services commence. While the Company will take reasonable care when carrying out collections, the Customer should move fragile items, secure valuables, and notify the Company of any particularly delicate surfaces or fixtures.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be limited or excluded under UK law.

10.2 Subject to the foregoing, the Company’s total liability for any loss or damage arising from the provision of the Services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable by the Customer for the specific booking giving rise to the claim.

10.3 The Company shall not be liable for any indirect or consequential losses, including but not limited to loss of profit, loss of revenue, loss of business, or loss of anticipated savings, arising out of or in connection with the Services.

10.4 The Company shall not be liable for damage to items or materials that have been identified as waste and have been authorised for removal, as such items are deemed to be discarded by the Customer at the time of collection.

10.5 The Customer must notify the Company in writing of any complaint or claim relating to damage or loss within 48 hours of the completion of the Services. The Customer shall provide reasonable evidence of the alleged damage or loss, and shall afford the Company a reasonable opportunity to inspect and investigate the matter.

11. Insurance

The Company shall maintain such insurance cover as it considers reasonably necessary in connection with the provision of its Services, including, where appropriate, public liability and employer’s liability insurance in accordance with applicable UK law.

12. Data Protection and Privacy

The Company will collect and process personal data necessary to administer bookings, carry out the Services, and manage customer accounts. The Company will handle such personal data in accordance with applicable UK data protection legislation and will take reasonable steps to keep personal information secure and confidential.

The Customer consents to the use of their contact details for the purpose of communicating about current and future bookings, invoices, and service-related updates. The Customer may request that certain forms of marketing communication be discontinued by notifying the Company.

13. Complaints and Dispute Resolution

The Company aims to provide a professional and reliable waste collection service. If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing details of the issue and any supporting information.

The Company will investigate complaints in a timely manner and will seek to resolve them through discussion, remedial work where appropriate, or a proportionate refund or price adjustment where justified. Both parties agree to attempt to resolve disputes amicably before considering formal legal action.

14. Variation of Terms

The Company reserves the right to amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that booking. Updated terms may be provided upon request or made available through standard communication channels.

15. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, such provision shall to that extent be severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.

17. Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation issued by the Company, constitute the entire agreement between the Company and the Customer relating to the provision of the Services. The Customer acknowledges that they have not relied on any statement, representation, assurance, or warranty not expressly set out in these Terms and Conditions.
